In the past, Microsoft OS licenses were a "one-time installation" only -
install it on one computer and it's "stuck" to that computer.
However, according to Microsoft's EULA (End User License Agreement) for
Windows XP Home edition, it states that XP Home may be transferred to
another computer or another person at least once:

"13. SOFTWARE TRANSFER. Internal. You may move the Software to a different
Workstation Computer. After the transfer, you must completely remove the
Software from the former Workstation Computer. Transfer to Third Party. The
initial user of the Software may make a one-time permanent transfer of this
EULA and Software to another end user, provided the initial user retains no
copies of the Software. This transfer must include all of the Software
(including all component parts, the media and printed materials, any
upgrades, this EULA, and, if applicable, the Certificate of Authenticity).
The transfer may not be an indirect transfer, such as a consignment. Prior
to the transfer, the end user receiving the Software must agree to all the
EULA terms."
Note that the license explictly states that WinXP Home may be transferred to
a third party once, so MS should not give the new owner any flak. However,
with all the headaches people have encountered just re-activating on their
own system after the OS thinks it's been re-installed (due to hardware
changes), I'm sure it won't be an easy walk in the park.
Hmmm, according to the MS Licensing FAQ
(http://www.microsoft.com/licensing/resources/faq.mspx)
"...you can call (800) 426-9400, Monday through Friday, 6:00 A.M.-5:30 P.M.
Pacific Time to speak directly to a Microsoft licensing specialist."
Maybe someone there can give you a definitive answer.
