Duane, it makes no difference that they say they thought the property was theirs...When they took title, they had the survey maps from the former owner, along with the deed, and then, they too had to have an instrument survey performed by a licensed surveyor. The evidence is easy for a magistrate to unravel. Whatever their prior knowledge, they knew that the contents of the building was not theirs. Did they get a permit to demolish the tower ? You must file charges within a specified period ( Michigan law...30 days ?). Since they now are going to be in litigation with the former owners, you had best strike while the iron is hot. They will be deadbeat, no doubt , but you can at least take a judgment and have it recorded, forever, in your County Clerk's office. It is likely a City Court ,Small-Claims dept. matter, since the money judgment sought will be less than $10k. Go get 'em...if I'm ever out that way, I'll show you ,strike that !, I'll show the boy a few little things that tend to level a playing field...I come from Brooklyn, where summary judgment saves a lot of time...Good night, Duane.
