Folks,

I sent this one over to the legal-eagle-hams forum, and, as is often the
case, Phil, K2ASP, performed a surgical strike, an excision of the guts of
the Petition onto paper, ready to dump into the biohazard waste container.
Phil, used to be a legal counsel for the FCC, and now works for us, via the
ARRL.

He's one of those guys that can take a seemingly challenging situation
thrown against him or a client, and finds the flaw, and rips it right out
and puts it on the table. An incredible resource, if on your side.
Others like him with their own special gifts of talent...Bruce Lee, Carlos
Hathcock, Gen Schwartzkopf, Condoleeza Rice...etc

These petitions are like cancers. There is too much cancer showing
up...everwhere. (I thought we got rid of most of the Whackos in WACO TX.
Apparently not....)

I think you shouldn't pussy-foot around. Use overwhelming, smart weapons to
take them out, and make those who wield them fearful of ever venturing out
with such a crazy thing again. Make sure they KNOW what hit them....real
science, and law, not BS.

Phil could probably take this out permanently, with 3 hours of his expert
time, and you would never see it again, at least around Gilroy or the
Central Coast. Phil's three hours, costs a lot more than my 3 hours, but
it would be very, very, cheap in the long run.

Someone also should buy a copy of the ARRL's Zoning book... and give it to
the Gilroy Mayor and Staff... and tell them to read it.
Get two copies, one for yourself too....it's probably a condensation of a
half million dollars of legal wisdom and 50 years of experience. on matters
ham towers, antennas etc..

73, good luck, and give Phil ([email protected]) a call...

Here is the petition text:

"No broadcast, microwave, or any other form of transmission tower, nor
>transmitter, emitting radio waves or any other form of radiation, may be
>allowed or permitted within 2,500 feet of any residence, school or city
>drinking water supply."
You can tell right away that the authors lack technical understanding. Can
we help this group create a fair and specific petition if they don't want
transmission towers in residential neighborhoods?
The good news is that Gilroy's mayor, Tom Springer, knows the petition is
too broad. He says, "The issue of wanting no radiation is understandable,
but presenting a petition that is well intended but vaguely worded and
poorly constructed is confusing and a problem in itself." Looks like a good
way for us to bring some technical expertise. Evidently a 75-foot tower is
planned near Welburn and Mantelli, and the petition is their reponse. I'm
sure interested in yours.
