I would read your contract you had with the photographer.
did you have one?
No? well shame on you.

Actually in the old days the negatives remained property of the study
and the customer purchased prints this went for studio portraiture and
weddings. When I woed in studios this is the way we did it.

Back in my youth I used to shoot some weddings to supplement my
industrial photography work ... since I hate dealing with customers ... I hate
hand holding and since I hated sorting proof sets and putting them in
albums I would charge a flat rate and send them to take the film after I
handed off off to them to colormark labs here in town. quick easy
money for n evenings work...

general rule unless it was agreed prior to shooting and production -
on for any photo work The negatives are the property of the
photographer.

you are correct about the photographer having to have a signed release
to use photos for promotional purposes...

but let me tell you.,., when it comes to news photos used in a news
contest... it is WHOLE DIFFERENT BALLGAME If I am at the Sideline
Fiesta Bowl and pan the crowd I can run peoples faces for the next
100 years. I had some lumox try to extort money out of me after a game
one time... I just about busted a gut laughing!

Hey Nic  & al;

When the photographer took my wedding pictures (digital camera,
of course), and we got together a week later to go over them,
The final bill was like $900 for his work (about 4 hours worth),
and another $200 for the full set of prints. (might have been more
or less - I don't remember).

I told him I don't want the prints. All I want is either a DVD
with all the photos on it or access to download them to my computer.

Here we go: [P = photographer] [M = me]

P: I can't do that.
M: Why?
P: Because they're copyrighted.
M: ???
M: What do you mean, "they're copyrighted"?
P: They're my "intellectual property".
M: ???
M: I dunno about that. They may have been taken by you, but
they are of me and my wife.
P: (blank stare).
M: Tell yah what: you give me a DVD and you save the time of
printing all the pictures, and I save $200.
P: I can't do that.
M: (now I'm getting cranked-off).
M: OK - here's my final offer: If you don't give me a DVD,
I'm NOT GOING TO PAY YOU, and since I haven't signed a release,
if you publish the pictures I'll sue you into the next dimension!
P: (no comment).
M: (getting up to leave) Ball's in your court - and remember: I had
plenty of friends there that were taking the important pictures,
as well as the silly ones - and they'll give 'em to me for free.

Got my DVD.

Of course, I brought my laptop when I picked it up to make sure that
it loaded all the pix onto my HDD.

That might not work with FedEx/Kinkos - but it did work on him! :-)

W6ESE - tony
