I don't know about the Baofeng, but several of the other brands have been through a FCC type certification process for use on some of the public service bands. I think it is part 90 certified I don't think it is part 95 certified, but I may be wrong on which parts they are certified on.
They are legal to use on the services they have been certified for. That is one of the selling points for some of the other brands I have kept up with.
Ham radios have for a number of years been able to operate out if the ham bands. Sometimes without any modification,and sometimes just by clipping a wire or diode.
They were not usually certified to be legal to transmitt out of the ham bands.
To be legal for some services, the radio must be programmed in certain ways.

I'm not sure of what you mean by the FCC comment. It is my understanding the FCC sets the bands and prosecutes those who transmit on frequencies for which they don't have a license. But to my knowledge the FCC does not block the construction of any broadcast equipment, nor do they block the sale of such equipment, based on its capabilities. Or do I have it wrong?
