At the receiving end, there is now difference in the perceived signal which 
ever way the signal was generated.  High end military transmitters have 
been generating FSK and CW by driving the USB channel with audio since the 
early sixties when the second generation of USB and ISB rigs were fielded.  
Reading the FCC's comments on the CW issue, one might conclude that the lawyers 
at the FCC aren't aware of that.  Which is hardly surprising.  :-).
