I have found that personal contact with the seller will often go a long way
in solving problems such as this. In this case, I assume that the seller did
not provide a phone number for contact. However, before enlisting the aid of
ebay/PayPal or public service agencies which may not find the matter as
important as you do, you might try some creative detective work on your own.
For instance, although a bit of internet surfing shows no listed phone
number for James Deaver, KI4KET, there are three other Deavers listed in
Weaverville, NC at www.whitepages.com. You might try calling them to see if
they are related to him. Perhaps they will provide you with his phone number
or at least contact him for you.
Failing that, it appears that Weaverville is a "suburb" about 2 miles north
of Asheville, NC. How about contacting the president of the Western
Carolina Amateur Radio society (listed under "contact us" at
http://www.wcars.org/ ) to see if he knows Mr. Deaver? If not, perhaps he
will "mobilize the troops" in the local ham community to help you with
contacting him.
Or, how about this? There are 67 listings at www.qrz.com for hams in
Weaverville, NC. Armed with a google or mapquest map and whitepages.com,
you could search for close-by hams who may have listed phone numbers.
Perhaps one of them will know Mr. Deaver and can help you with contacting
him directly.
Finally, you might also try searching for IRLP or Echolink access to the
Asheville area. Direct conversations with a few of the locals might unearth
some information about Mr. Deaver.
My only experience with needing to directly contact an ebay seller has been
with the infamous Martyn Allison (ebay seller name "radio-mart"). Actually,
he was quite pleasant on the phone and resolved my complaint quickly and
satisfactorily. I hope that you have a similar experience with Mr. Deaver.

I am looking for info from other list members, as I am
sure that others have gone thru this. A couple of
weeks ago I used the Buy It Now option on ebay to buy
an Alinco DX70TH from KI4KET in Weaverville, NC. I
paid for it immediately with paypal. He said he was
going to send it the 27th of March, but I have never
received it, and the tracking number he sent me shows
that UPS never took possession of it. He now won't
answer my emails or phone calls.
I may or may not get my money back from Paypal, but I
want to take legal action against this seller for
theft, because that is what it is. Which legal
authority do I need to start with? How much luck have
others had with pressing charges for ebay theft?
Any info would be appreciated.
