I would vote mostly against the seller and part against the buyer. Any seller that doesn't test the knobs and switches and does not state they are frozen is dishonest. the buyer may have expected too much also. Although I doubt he would have bought it if the frozen knobs and switches were mentioned. 

I have been equally cheated by internet advertisers and ebayers, hams and non-hams.
