Hi Dale,

The City Manager, with that level of ignorance and cockiness, is setting
himself up to be made a fool of publicly AND potentially cost "his" city
many dollars defending his attitude and statement!

If the details of what you're saying are true and you're not
exaggerating, those requirements are EXACTLY what PRB-1 defends against.

The City Attorney needs to be approached with PRB-1 and the facts of the
case and let him straighten out the City Manager. You might be wise to
pass along the facts of this to ARRL for their legal involvement too.

Use the ARRL! They "LOVE" this type of battle. It sounds like a fairly
easy win.

Keith, KF4BXT

Subject: [FLARES] Marco Island Anti-Ham Movement

Hi All-
The City of Marco Island, in their infinite wisdom, has decided that
amateur radio is a bad thing and are requiring a conditional use permit
to erect a tower in the City. This entails an envirinmental impact
study- an engineering report, etc. which is around 4 or 5 thousand
dollars to have done. The city manager when informed of PRB-1 and the
state law to the same effect is quoted as saying- "This is Marco Island,

we control what goes on here."

A local ham is embroiled with in a zoning/permitting dispute and the
City is claiming that his radios will cause cancer and he can use them
to listen to police conversations!

I live on Marco- this is a barrier island. Can everyone say "Shoot
yourself in the Foot"? I know Sherri has some experience with this type

of insanity- some help would be appreciated.
