some possible additional lines of arguments:
* Part 15 is the only law that stands between order and anarchy in =
frequency use. Allowing ANY unlicensed frequency allocation grab to =
occur by excepting Part 15 opens the door to the end of all licensing =
and frequency allocations. Radio spectrum anarchy.
* If Part 15 is excepted for one, then it should excepted for all. =
This ends any need for the FCC. The FCC should simultaneously go out of =
existence when it makes a Part 15 exception.
* Why would a not-for-profit public natural monopoly be permitted to =
earn income in competition with private enterprise? Power companies =
should NOT be permitted to do that.
* Since BPL would interrupt/end citizen communication via HF and HF is =
the only frequency where such is possible, it is an abridgement of Free =
Speech.
* Since HF frequencies skip, excepting part 15 allowing interferrence =
on skipping frequencies turns US powerlines into international jambers =
in violation of international law. Of course if it doesn't interefre, =
then no exception to part 15 is needed, so even requesting the exception =
is an admission of interferrence.
* Since HF is the only tiny part of the spectrum that skips, risk to =
disrupting it interferes with military and emergency communications =
systems. If BPL is to be permitted anywhere, it should be in a VHF zone =
where that risk is not run. How about 900 mHz. If it is interferrence =
free, no worries.
* If they argue it doesn't interfere, then of course there is no need to =
except Part 15.
