Ron, without resorting to expatiation, here is my condensed opinion.
Today, if I live in an HOA-controlled community they could legally prevent
me from erecting a ham radio antenna for no other reason than "because
that's our rule". Contravening that contractual restriction could cost me
monetary sanctions and might even place my home in jeopardy.
Next year (if this legislation were adopted) Federal law will require the
HOA to engage in a good faith attempt to REASONABLY accommodate an Amateur
Radio need for an effective outdoor antenna system while also being mindful
of the LEGITIMATE concerns of the HOA.
Not an argument, just an opinion. It won't hurt my feelings if your opinion
isn't congruent. You're a fine Ham in either case.
