Hans,
Even though DoD did prohibit CW on their frequencies - I'm working on
getting a copy of the letter now, it doesn't affect your enjoyment (nor
mine) of CW on the ham bands.
But it does do one thing - ever since the DoD did away with CW, it has been
illegal for use during Armed Forces Day.
I also think it is really picky because unlike all other repeaters in the
USA, MARS repeaters CANNOT use Morse Code to identify themselves.
My friend W1DV was Chief Navy MARS before he retired from the Navy and he
told me the reason that Morse was made illegal was because of some Army
General who had his head stuck in a physically difficult to achieve posture
if I remember correctly.
If I can't get a copy of the letter from the Assistant Secretary of Defense
which prohibits CW, I will try to contact Dave, W1DV and ask him.

In 21 years of Naval service I never even once heard of that practice. As
far back as 1958 when I first went to sea on "government ships", you'd have
been "corrected" for such behavior, since it would violate both ACP121 and
ACP124.
CW is in fact no longer used in many applications that it once was,
including MARS.
But it is NOT prohibited on every DoD circuit and there are in fact still
trained Morse operators in the Armed Forces.
Neither is it "illegal" as in "against the law" and thus subject to criminal
prosecution. If someone told you that, they're simply "off their nut".
Even if all your jeremiad about the DoD were true, how does that affect my
enjoyment of Morse in the amateur radio service?
