It wasn't my intent to attack the ADA law even though I have known of some 
cases of over-zealous implementation with small businesses, but that's not 
to  be unexpected with any law or government regulation.

I seem to recall that bogus ADA waivers WAS their primary stated reason for 
lowering the code speed - they just didn't want to deal with the situation, 
and 5 wpm for everyone was the easiest way out.  They "dropped" the waiver 
by extending it to all licence applicants.

Regardless of one's opinion pro- or con- ADA, the fact of the FCC's decision 
remains.  I don't think it is realistic to expect the Commission to 
reinstate any kind of code speed test above 5 wpm for the CW-only subband 
that has been discussed over this board.  Besides, administrative government 
agencies such as the FCC seem to operate under the assumption that they 
posess infinite wisdom.  They rarely, if ever, voluntarily reverse a 
decision once it has been made.
