[CVRC] Douglas County Antenna Ordinance (Final)

At Thursday's Douglas County Board of Commissioners meeting the new amateur
radio antenna ordinance was unanimously PASSED!
The new ordinance does not affect CC&Rs which may contain more stringent
requirements.
The ordinance speaks to two lot sizes: small (less than one acre) and large
(one acre or more).
Aside from any building permit that may be required, all lots may erect
towers of 35 feet with no County Planning Department approvals.
For a small lot to exceed 35 feet, the applicant must apply for a Major
Variance.
For a large lot to exceed 35 feet (but not more than 75 feet), the
applicant may apply for a Minor Design Review and a 50-foot setback will be
required.
For a large lot to exceed 75 feet, the applicant must apply for a Major
Variance.
A Minor Design Review requires notification of immediate neighbors and can
be approved at the County Planning Department staff at a design review
hearing; it does not require a public hearing at the planning commission or
board of commissioners level. Immediate neighbors may protest the
application, and the planning official can either decide it or refer it to
the planning commission; in either case, the decision would be made on
objective factors, and the application does not require consensus by the
neighbors. A Major Variance will require adjacent property owner
notifications and a public hearing.
Planning approvals do not remove the requirement for all tower
installations to obtain appropriate County Building Department permits and
approvals.
