 I will make it available to the DPPOA Board this evening. 

I certainly agree with your steps, and note #5 in particular that there will have to be a consistent volunteer performance to keep a" team" as well as volunteer training current.  This may be a problem if history serves as a lesson.

Good Morning Peter, 

  

As a follow-up to our excellent conversation yesterday, it is important to put our discussion into action.  I understand your concerns regarding liability and the ineffective way it seems to be addressed.  Primarily, if you act in good faith and you do not go beyond the scope of your training, you will not be held liable under the Tort Claims Act.  This will not prevent someone from entering into a law suit against you, the County, Drum Point POA or anyone else they choose to sue.  Before a resolution to the liability concern can be addressed, there are several things which must be completed. 

1.     An overarching CERT Plan must be developed.  There are several members of the CERT volunteer community which have been traditional stalwarts (which includes you) of this group.  You identified Bill Hackett and Bill Smith, I recall Bill Roggenbrodt.  An effort to have a small group get together to develop this plan must occur.  Christina can lead this effort along with assistance from others in Emergency Management, but without help from the CERT group it is unlikely to be successful. 

2.     Roles and Responsibilities must be identified which provides the CERT personnel and the County a basis for utilization. 

3.     Authorities must be identified. 

4.     The mechanism for deployment, what it means and doesn’t mean will be identified. 

5.     How the program is going to be maintained is important to the effort. 

  

We have information from the state and once the plan is developed, it can be vetted through the County Attorney’s office to ensure everyone is covered in an acceptable manner.  I would like to understand the hold harmless agreement and how it protects each party.
