I have argued this to the ARRL and it falls on deaf ears.
To allow the Feds the ability to modify existing contracts sets a terrible 
precedent.

To do so violates the principles of Contract Law.
These restrictions were known when the lease
or mortgage was signed.
Just don't see the Feds agreeing to do that.
Perhaps there's some kind of compromise, but
will take someone smarter than me to find it.
