[Boatanchors] Illegal tx in OZ ??

Gentlemen.

Unless the regulations have changed in recent months, the situation is that
it is illegal under the Radiocommunications Act1992. (ACMA , the government
Communications  Authority) section 47  provides that '... a person must not
have a radiocommunications device in his or her possession for the purpose
of operating the device otherwise than as authorized by (a) a spectrum
licence, or (b) an apparatus licence or (c) a class licence .
 In effect this means that a commercial AMATEUR transceiver must not be
modified to 'operate' on a frequency outside the  amateur bands . Not only
is it  offence to modify but it is  also illegal to operate a device that
has not been type/technically approved  to operate in a commercial service .
Class licences  are for  example CB or 27Mhz marine  and it is therefore
illegal to MODIFY an amateur transceiver to operate on those sections of the
spectrum..
 The reverse of  all this is that it is OK to modify commercial equipment to
operate on  amateur  bands .
In the end, the legislation is clear---- we cannot modify commercial amateur
equipment to transmit on non amateur frequencies 

Any confusion in the mind of  advertisers is in my view a distortion of
facts as presently exist
