Ok, this pretty much floored me.
Saw this on an ad for a FT on ebay.
for auction i have a YAESU FT DX 400 ham radio with ym 844A microphone
this radio is fully functional with no faults can produse 300 watts on
transmit
unfortanutly the ACMA have now deemed this type of transmitter illegal under
the current law as it will transmit out of band
therefore i am selling this radio as parts only not working
it is rather unfortunate thet the law has been changed on these older radios
i only accept paypal certainly no pick up due to abusive dealers in the past
this radio is advertised elswhere and may be removed during auction
please refer to the ACMA web site for clarification of the act

yes unfortunatly any vfo hf radio like TS 520 FT 101 etc etc can incur a
two your imprisonment just for owning one

Unless I've missed something somewhere, this only applies to people without
an appropriate amateur license, as we are deemed technically competent to
ascertain that we are operating within our band limits. (Seller doesn't
mention if he is a ham, but it seems unlikely. I hope not.)
The ACMA website is down right now (server maintenance all weekend) so I
can't quote the exact rules in question, but I can't see how that would be
so, even band restricted radios are capable of going out of band to some
degree, that's why we have to know our band limits and abide by them. I
have an FT200 and I'm pretty darn sure it's not unlawful to own it or use it
lol.
I will follow up with ACMA of course, I've no doubt there is no reason to
think we should all suddenly go back to radios without a VFO...
My guess is that this guy has been operating on the 11m CB band or elsewhere
as a pirate with this thing and either got caught out or someone complained
about interference and he's worried about the Radio Inspectors paying him a
visit. Mind you, even if it was crystal locked, it's not type approved for
CB and 300w is going to get someone's attention I think. Thought you might
all be amused by it.
(Yes I will be trying to buy the radio lol)
