The only band on which the carrier must be at least 40
dB down is 60 meters. Otherwise there is no
regulation that says that you must have a signal that
has the carrier 40 dB down.
The 40 dB down is a techincal definition and not a
legal requirement except for 60 meters. There are all
sorts of transmitters out there that don't have as
much as 40 dB "down" for the carrier.
