One of the last shipments that I made using UPS before
going to FedEx ground (over 2 years ago) was going
less than 200 miles (from Richardson, Texas, to the
Shreveport, Louisiana, area).  Somehow the label that
UPS puts on the box (the one with the barcode) came
off.  My label with the correct address, etc., was
still attached.  However, without the barcode UPS
personnel cannot "read" the label!  

I guess that being able to "read" English is no longer
a requirement for employment at UPS!

After I filed a claim UPS finally found the box at
their equivalent of the "dead letter office".  They
opened the box and described to me the contents.  Then
they repacked the box and sent it on its way.  When
the box arrived the person to whom I had sent the
transmitter said that the box looked like it had been
used for a basketball.  Frankly, the unit was in
shambles.

Of course UPS tried to say that the box was
"improperly packed".  However, UPS was supposed to
open and inspect EVERY box that was presented for
shipment at a company owned facility.  Of course they
can not open every box.  However, it is grounds for
immediate dismissal if an employee does not open the
box and verify the packing.  Thus, no employee is
going to admit that they did not open and inspect the
packing.  By checking the box UPS legally takes full
responsibility for the packing.

When the national UPS customer service representative
tried to "pull" this "improperly packed" thing on me I
"reminded" her of the UPS policy of opening and
checking the packing.  I also pointed out that UPS
personnel had opened and inspected the item when they
were looking for the package.  Then they repacked the
item.  Therefore UPS was definitely legally
responsible for the package.  The woman on the other
end of the telephone line got very quiet.  Then she
told me that the claim would have to be handled out of
the Fort Worth office.

Within 5 minutes the telephone rang with a call from a
representative from the Fort Worth regional office
(Fort Worth takes care of the entire Dallas / Fort
Worth area).  I was told that the proper paperwork was
already in the mail for my claim.  After I filled out
the paperwork and sent it in, I got another telephone
call telling me that my claim for $100 was being
"taken care of".  I then pointed out that the claim
was for considerably more money.  The representative
then "looked" at the insured amount, got very quiet,
and then said that a cheque for the entire amount
would go out shortly.

About 10 days later I got a cheque for the insured
amount plus the cost of shipping.

Frankly, UPS will try everything that they can do not
to pay a claim (they own the insurance company that
"insures" the shipments).  However, if you point out
that it is now company policy to inspect all boxes
before they are accepted for shipment (there are large
signs over the customer counter at UPS owned shipping
centers) and let them know that you do know your
"rights" they will "pay off".  Of course you have to
be firm, but do NOT lose your temper, use profanity,
etc.  

However, UPS is responsible ONLY to the shipper and
NOT to the cosignee (the person to whom the item is
shipped).  This is a Federal regulation.  Therefore,
you have to get the person who shipped the item
involved.  If they do not want to get involved (and
there are a lot of people who do not want to get
involved) then you have problems.  If they are in the
same state as you then you do have small claims
courts.  But, if they are in another state (unless
nearby) you are going to have a lot of problems suing
them.  It is possible, but a real pain in the
posterior.

BTW, as an added note, my new 75A-2A that was supposed
to have been delivered on the 25th has now been found
to "have not been delivered" but the more than
competent and brilliant UPS folks.  A 26 X 26 X 26 or
bigger box containing this unit was scanned into the
Mesa Terminal on the 25 for delivery and suddenly
"disappeared" into thin air.  I wonder what black hole
all this stuff that "disappears" in the their system
does with all the lost and damaged boxes/packages.
