That is not true! A licensed amateur may indeed use
this amplifier on the 10 meter band so long as the
spurious emissions, etc., meet the standards of 47 CFR
Part 97. However, it IS illegal to use this amplifier
on the 11 meter band or on any other frequency except
for an amateur band.
The "type acceptance" applies to linear amplifiers
offered for commercial sale. However, a licensed
amateur is free to modify any transmitting equipment
to operate on amateur frequencies so long as it meets
the technical requirements of Part 97. This includes
"home brew" as well as any other item.
