Hi Duane,
I live in MI too. I am fairly familiar with the state small claims
court.
I also know that most attorneys don't know the ins and out of small claims
court.
They are a poor source of advice for the venue since they never practice there.
I, however have occasion to go there since I have my own business.
If you know the parties address, and you do, once you have a judgement
against them, they can be forced to come to court under a "subpoena on
discovery".
That means that they have to show up with every scrap of paper, title, bank
account,
etc, that is pertinent to ANYTHING they own! You and the court go through
the stuff,
and you can attach and force to be sold ANYTHING they have that doesn't
have a lien against it.
You may also attach their house so that the thing can't be sold with out
your being paid.
You've already spent more than all of this would've cost. There are some
more details
that I've left out bout if you call the local district court and talk to
the magistrate of the
court, they will be more than happy to guide you through the
process. Oh, one more thing. In small
claims, the defendant pay the cost if are found guilty. So quit being
depressed and go lout and kick
some butt!!! I'll feel better when you do
