This week I received a letter from Rep. Jef Flake (R-Dist 1) regarding the
Amateur Radio Emergency Communications Consistence Act, H.R. 4720.
It is a thought provoking letter. He never really states his objection to
the resolution in so many words, but refers to it in the end of the second
paragraph.
This is the text of that letter:
"Dear David,
"Thank you for contacting me in support of the Amateur Radio Emergency
Communications Consistence Act, H.R. 4720.
"While I am sympathetic to your position, I do not believe this issue
warrants action by the federal government. H.R. 4720, originally sponsored
by Representative Steve Israel, would apply a 1985 ruling by the Federal
Communications Commission on the installation of antenna structures to all
private landowners and homeowners. This ruling established a 'reasonable
accommodation' that local authorities must provide to amateur radio
operators wishing to install antenna structures on public land. According
to this ruling, local and state governments may not completely ban amateur
radio antennas. H.R. 4720 would regulate all private land use rules and
contracts.
"H.R. 4720 has been referred to the House Energy and Commerce
Subcommittee on Telecommunications and the Internet, where it is awaiting
further action.
