Not quite always this cut and dried, unfortunately. What about the hospital
with 2 hams - one is sitting in the security office, and the other is
walking around the grounds/buildings doing "radio checks" every couple of
minutes - stating his location each time and getting a report at each.
Technically, the argument can be made that this is viable "dead spot"
searching. In reality, it's the two security guards doing their every day
job (rover patrolling the hospital and reporting where they are to base)
that should be done on the hospital business radio. Common sense would tell
US that the second day it happened that they were breaking the rules - but
if they don't stop (or get told by the FCC to stop) in the meantime they've
"stolen" a piece of one of our bands.
There are a million shades of gray between this obvious violation and "never
on it", and somewhere someone has to draw the line, or they'll just steal
our bands (or some agencies will, in some areas, anyway). The FCC has said
this line is "don't do it, ever, except in a real emergency". Then modified
this with "if your response plan includes the guard using the ham radio in
the security office, then get a waiver in advance for him before you hold
the hospital net/SET or whatever.
The line COULD have been drawn anywhere, but for now, that's where it is.

With various facets or branches giving away my tax dollars hand over
fist with little oversight to various entities in order for those entitiies
to continue to make more money (probably by taking it out of my pocket with
the other hand), it seems that the FCC is being more than a little hardnosed
in their strict interpretation of "pecuniary interest." There is no money
being made for the participating entity in a disaster drill. Granted, the
employee/ham is being paid to perform a duty but for the public good. It
would be interesting to know what dim-witted bureaucrat came up with this
interpretation and what his "pecuniary interest" is in this.
As regards to the length of time to receive a waiver, ask the car
dealers how long it takes a government agency to process paperwork.
This is another incidence that shows the FCC is not the ham's friend.
