Yes ... Part 97.113 Prohibited transmissions only applies to
amateur radio operations.
Therefore, since MARS, operating on frequencies outside the
amateur radio service, is outside Part 97 oversight, the rules
are different.
While the article mentions "ham radio communication", as you
know, that would not be allowed on amateur radio frequencies.
To the lay person, anything that somewhat looks like ham radio
is ham radio. :)
