[ARRL-OK] Ham rigs being used in Commercial Service

I need some help since at the present time I do not have time to try and 
dig up this information.

It has come to my attention that a number of Police Officers in Muskogee OK 
and the surrounding area  are purchasing ICOM 2 meter radios and then 
having an individual modify them for operation on Public Safety frequencies.

These officers have City supplied Motorola UHF radios for use in the jobs 
thay choose to purchase the Ham radios so that they can operate on VHF 
frequencies, many of which the City does not hold a license for our use of 
those frequencies.

When I informed the Police Chief of the situation....after a citizen 
complained to me, his comment was "Show me in the Rules where it is Illegal".

This problem not only effects the City of Muskogee but also the counties 
surrounding Muskogee County.

Can someone give me a quick pointer where I can find the information I need.
