I hope I don't add fuel to this fire!  (pardon the pun) I own an IC-V8 and 
although it is a great radio however, it physically is not sturdy enough to 
work in the public safety arena.  The FCC ruling points at the fact that 
radios in the amateur service are not type accepted for public service.  Type 
acceptance covers a wide range of conditions some of which include the 
characteristics of the RF signal.

We ran into this problem in Omaha. A small city gave amateurs with UHF radios 
which were capable of transmitting above 460 MHz permission to call the 
police dispatchers directly and pass emergency and other safety related 
traffic.  It was a great program but was hindered by the type acceptance 
regulations.  The city overcame this issue by supplying amateurs that passed 
a background check with Police Ht's.
