I am not complaining! In fact, I have said before that I have no objection to the FREE distribution of my articles that were in 73 Magazine. However, I do object to those who are selling those scans of 73 Magazine. If someone is making a profit, no matter how large or how small, then those persons who own the copyrights are definitely entitled to royalties.
Most magazines, including 73 Magazine, purchase / purchased first distribution rights and often first reprint rights. Copying, redistributing, etc., of copyrighted material is against the law by anyone who does not have the permission of the copyright holder unless the copyright has passed into the public domain. Every author is entitled to being paid for any use beyond the original rights purchased by the magazine, etc. The ARRL often publishes articles in the Handbook, specialty manuals, and so forth. Since they don't wish to have to pay the author for these additional publications, the ARRL demands the transfer of the copyright. Other publications are willing to pay additional if the material is used beyond the original agreement.
Before the demise of 73 Magazine, there were a number of requests, made to the magazine, to reproduce articles that were written by me. In every case, the request was forwarded to me because 73 Magazine did NOT own the copyright. I always made it clear, to those wanting to reproduce my articles, what is listed below on my website. If those conditions were met, then the reproduction could be made without payment to me. However, if the person requesting the permission was going to charge for the publication, then I was definitely entitled to payment for using the article. For some "strange" reason, when the person was going to charge for the publication, I never heard anything from them ever again! Being paid for an article by the original publisher does NOT give anyone else permission to reproduce the article for their benefit. That is one of the reasons that copyrights exist in the first place.
If you take time to look at my website, on the page that involves K9STH, http://www.k9sth.net/about.html you will find the following statement:
Articles in this website may be reproduced in other amateur radio publications, unless otherwise indicated, if the following conditions are met:
1. The publication MUST be non profit. That is, there is NOTHING charged for the publication. This restriction does not apply for bonafied amateur radio organization's dues.
2. The copyright notice MUST be maintained.
3. No editing, at all, is to be done. That is, the entire text, of the article must be presented with NO CHANGES at all!
4. The name of the author MUST maintained and no other names added.
5. A copy of the publication MUST be furnished to Glen E. Zook, K9STH

Even though Wayne Green, before he died, publicly posted, on several E-Mail reflectors, that he did not care if scanned copies of 73 Magazine were made available, at no charge, the truth be known is that he had no legal right to make such distribution. Since the article copyrights are still owned by the authors, each author would have to agree to such distribution and that is not possible. In the situation where the original author had died, his / her heirs would have to agree to the free distribution and finding these persons would be very difficult, if not impossible. However, the entire 73 Magazine collection is available for free from several different Internet sources and, unfortunately for the original authors, there is absolutely no way for them to get the royalties to which they are really entitled.
You got paid once and that should be enough considering this is a hobby. Add to the facts that the magazine is out of production since 9/2003 and you stopped writing for them in 1973.Why do you keep complaining all over the Internet about the same subjects?
