Hello Ian,
Your first statement with respect to eBay is quite incorrect.
As soon as you submit a bid on eBay, you get a bunch of text informing you 
that you are entering a contract.
Perhaps you are saying there are contracts and then there are eBay 
contracts? Is that your stance / belief?
And I do think it would have been considerate for you to have trimmed your 
reply; some of us still pay for download volume.
