Someone can claim a copyright on the format of the media in which the material is contained.  The actual material, if it is in the public domain, is NOT copyrighted.  For example, if the person adds a cover page, additional information, etc., that material can be copyrighted.  However, the actual, original, document contents are not subject to the copyright if the information was in the public domain.

If the person selling the information is offering material that is not in the public domain, then that person has to have the permission of the actual holder of the copyright to legally sell the material.

  When looking over the sources for continuing education sources for my PE renewal, I found that many
of the "Engineering" sources were in the public domain, however get a certificate you had to use a service
to take a 5 question multiple choice exam and pay for out the nose.  
  Most of the documents at one source was mostly military training manuals on electronics which is in 
the public domain.
