I think you are right - be very kind to this neighbor. In addition I am surprised that you can get away with this from a zoning perspective. Most zoning regulations that I have looked at (even those that are kind to hams) require that the tower be far enough away from your property line to insure that if the tower fell it would fall totally on your property.
