I didn't miss anything. If you feel "non-voice" (whatever that really
means) should not be in the phone band, make your case to the FCC with a
proposal.
SSTV has always been authorized in the phone portions and if I talk into
a microphone connected to a transmitter and it goes out over the air,
regardless of whether the content is digital or analog, it's phone.
Everyone has the right to QSY, and should have the ability, when adjacent
frequency interference becomes non-tolerable; some just don't exercise
that right regardless of the reasons.
