[Alexandria Radio Club Reflector] New Virginia Law on Mobiles, July 1st

This is only the beginning.  Our State Senator tried last year to pass a law that outlawed all communications from a "personal communications device (exempted CB radio)," but then KI4D brought to his attention the collateral damage his law would cause.

Undaunted, it was tried by somebody else this year.  I believe this bill was a "compromise" that was worked out.  My guess is that next year, there will be another bill to make communications illegal anywhere while driving, like the rest of the nanny states.  Now is the time to educate our State Senators and Delegates that using a 2 way radio is NOT an issue.  These people haven't got a clue when they propose these bills what they are talking about.   

I remember seeing something (on WTOP?) about the current law about texting and driving being very difficult to enforce, so there was some discussion about how this law will be enforced.

However, there is a Petition for Rulemaking floating around the FCC asking the FCC to overrule states and localities when it comes to use of Part 97 equipment while driving.  One of the comments pointed out FCC needs to extend this to the Part 90 and 95 services as well.  The petition is RM-11833 and I think it is still open for comments.  It probably won't go anywhere, but its worth a shot.
