You're right, George, the rules are crazy!

Bill, K5FUV opined here a while back that FT8 may not actually be a 
legal digital mode on 5 MHz given the way the access authorization rule 
for specific modes on a frequency is specified.

The best advice I can give is to proceed very cautiously if it is a gray 
area but submit to strict compliance when it is black and white, like 
our frequency authorizations.

I will go ahead and mention that you will recall during the last World 
Radio Conference a secondary 5 MHz allocation was authorized for the 
Amateur Radio Service worldwide. It is not a fixed frequency channel 
authorization, rather a very small frequency band but with just a 15 
watt power limit! Some countries around the world have allowed amateur 
access to this allocation however the United States has not. ARRL did 
petition the FCC for access however to do so the FCC wants to remove the 
100 watt five frequency segments. The ARRL's position, to which I fully 
agree, is to allow the new authorization and retain the current 
authorization. Discussions between ARRL and FCC continue.
