[1000mp] PCT III Not Legal USA? - Sound Card Digital/Ritty Modes

Hello Remeeus, very much appreciate your informative reply.
My email was triggered by what I considered a misleading blanket statement
of the following:
"However... With the modern TNC's (such as the SCS PTC-IIpro) or with a
soundcard the bandwidth is not important anymore. The DSP of the
TNC/soundcard handles with the signal, independent of the bandwidth. With
the new Pactor III mode it is even impossible to use narrow bandwidth!"
I just felt it was important to keep the receiver filter bandwidth issues in
perspective when it comes to improving the performance of what Tnc's and
Sound Cards can do... running wider filters than the mode in use by the Tnc
and Sound card program was not the point I think you were trying to make.
Also there is some question of the legality of Pactor III in the United
States. Please see the attached example of many emails on this topic else
where.

Subject: [DigiMode_HF_Band_Plans] More PCT III info...
I put the following on my website last week. I got this info from
discussions held on the digitalradio e-group at
http://groups.yahoo.com/group/digitalradio/. If I am wrong on any of this
info, I assume some Pactor III op will flame me an email... ;-)
PACTOR-III is a proprietary mode used for non-amatuer communications. Use
of Pactor-III protocol is prohibited for US hams and some other countries
for the following reasons:
1 . PACTOR III is not publicly documented, it is illegal for any US
licensed station to use it (section 97.309(a)4 of the rules).
2. There are no bilateral agreements with any other nation permitting the
use of PACTOR III, it is illegal for any US licensed station to use PACTOR
III in communication with licensees of any other nation (section 97.309(b)
of the rules).
3. PACTOR III signal may not be used for an automatically controlled
station (maximum bandwidth is 500 Hz) (section 97.221(c)2 of the rules).
4. PACTOR III has a symbol rate higher than 300 baud, operation by US
licensed stations below 30 MHz would violate 97.307(f)3.
